Terms of Service
These Terms of Service (“Terms”) are an agreement between you and Ocean View Marketing(“we”, “us”) governing your use of Drunk Wizard at drunkwizard.com(the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
Drunk Wizard is a tool for running live fantasy football auction drafts: a shared draft board, phone-based bidding, budget tracking, and league administration. It is a scorekeeping and coordination tool. It is not a betting platform, it does not handle wagers, prize pools, or payments between league members, and it does not host any game of chance.
Any money your league plays for is entirely between you and your league. We are not a party to it, we do not process it, and we take no responsibility for it. You are responsible for making sure your league’s activity is legal where you live.
2. Your account
- You must be at least 21 years old to use the Service.
- You are responsible for the accuracy of the information on your account and for everything that happens under it.
- Keep your password and any guest bidding links private. Anyone holding a guest link can bid as that team.
- Tell us promptly at the address in section 12 if you believe your account has been accessed without your permission.
3. Acceptable use
You agree not to:
- Use the Service to break the law, or to run activity that is illegal where you or your league members are located.
- Access another league's data, another member's account, or any part of the system you were not granted access to.
- Attempt to interfere with, overload, reverse engineer, or disrupt the Service or the servers it runs on.
- Upload content that is unlawful, harassing, hateful, defamatory, or that infringes someone else's rights.
- Scrape or bulk-extract data from the Service through automated means, except as we expressly permit.
- Resell or commercially redistribute access to the Service without our written permission.
Team names, league names, and reactions are visible to everyone in your league. Keep them within the bounds of what your league is fine with — and within the rules above.
4. Commissioners
If you create a league, you act as its commissioner. You can invite and remove members, assign teams, issue guest links, edit rosters and budgets, undo sales, and reset league state. You are responsible for how you use these powers and for the accuracy of the results you record. Members of your league can see the league data described in our Privacy Policy.
5. Your content
You keep ownership of the content you put into the Service — league names, team names, rosters, imported spreadsheets, and the like. You grant us a limited, non-exclusive license to store, display, and process that content for the purpose of operating the Service for you and your league. That license ends when you delete the content or your account, except for copies retained in routine backups.
You represent that you have the right to upload whatever you upload, including any spreadsheet or player data you import.
6. Player data and third-party names
Drunk Wizard is not affiliated with, endorsed by, or sponsored by the National Football League, any NFL team, the NFL Players Association, or any fantasy sports provider. Player names, team names, and logos referenced in the Service belong to their respective owners and are used for identification only.
7. Availability
We do our best to keep the Service up, especially on draft night, but we provide it on an “as is” and “as available” basis. We may change, suspend, or discontinue any part of it, and we may impose limits on usage. We do not guarantee that the Service will be uninterrupted, error-free, or free of data loss. Keep your own record of results that matter to you.
8. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements or that any defect will be corrected.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the outcome of any draft, league, or wager, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Suspension and termination
You may stop using the Service at any time and can delete your account from your account page. We may suspend or terminate your access if you breach these Terms, if your use creates risk or legal exposure, or if we discontinue the Service. Sections 5 through 9, 11, and 12 survive termination.
11. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the courts located in the State of California, United States for any dispute that is not resolved informally.
12. Changes and contact
We may update these Terms from time to time. When we make material changes we will update the date at the top of this page. Continuing to use the Service after a change means you accept the revised Terms.
